Acquitted after tragedy: Father cleared in case over son’s fatal accident

KUCHING: A labourer, Mr Sim who was  charged under Section 44(1)(b) of the Road Transport Act 1987 over a tragic accident in May 2023 that claimed the life of his three-year-old son, has been acquitted after the Deputy Public Prosecutor withdrew the case.

Michael Kong, Special Assistant to MP Stampin Chong Chieng Jen, said the case had been deeply emotional from the start as Mr Sim was the sole breadwinner, supporting his unemployed wife and their two young children, aged three and under one.

“It was clear from the outset that this was a heartbreaking accident, not one of malice. Mr Sim has shown deep remorse and suffered greatly alongside his family. His wife and family had also formally requested for the case to be discontinued, recognising the immense toll this tragedy has already caused,” he said.

Kong added that after months of making representations and appealing for compassion, the Deputy Public Prosecutor agreed to withdraw the case. 

“When the decision was delivered, Mr Sim and his family broke down in tears of relief as it was a profoundly moving moment for everyone present,” he said.

While expressing gratitude for the compassionate approach taken, Kong also reminded motorists to drive responsibly.

“Nothing can undo the pain caused by such accidents, but we can all play our part in preventing future tragedies,” he said.
