Court of Appeal dismisses Michael Kong’s stay application in defamation suit

KUCHING: The Court of Appeal today dismissed an application by Michael Kong to stay the execution of the High Court’s decision in a defamation suit filed by Richard Wee.

His legal counsel, Chong Chieng Jen said the suit stems from a Facebook post dated 21 July 2020. On 26 January 2024, the High Court ruled in favour of Richard Wee and ordered Michael to pay RM200,000 in damages, with 5% annual interest calculated from the date of publication until full settlement. The court also awarded RM50,000 in costs.

Michael subsequently filed an appeal against the decision and sought a stay of execution while waiting for the Court of Appeal to fix a hearing date.

However, Chong added that the Court of Appeal this morning rejected the stay application and directed the immediate removal of the Facebook post in question. Michael must now pay the judgment sum of RM200,000, along with accrued interest and an additional RM10,000 in costs, bringing the total amount payable to approximately RM310,000.

Despite the court’s decision, he said Michael intends to proceed with his appeal in an effort to overturn the judgment. 

Chong added that Michael’s political struggle and legal battle alongside this journey has not been easy, but together with Michael, we remain steadfast in his conviction and will continue to pursue the appeal to clear his name. “In the meantime, if you believe in the principles that underpin this case and would like to offer support and encouragement to Michael in any way,  it would be most sincerely appreciated,” he said.
